In accordance with the applicable regulations, Casa Barbara undertakes to protect the personal data collected and processed in relation to its users and to inform you about the use of cookies on its website.

“Personal data” means any information relating to you as a natural person that you voluntarily provide to us or that we collect in the course of your browsing and that allows you to be identified, directly or indirectly.

This information notice is intended to provide information on the personal data processed by Casa Barbara, how it is used, and the rights of individuals whose personal data is collected. Personal data of users

1. WHICH PERSONAL DATA ARE COLLECTED BY CASABARBARA?

When we are contacted via our website, by post, email or telephone, or when we are directly approached on our premises, we collect the following personal data relating to persons interested in our services:

  • Their identity and contact details
  • The type of accommodation, the departement and the desired date of entry
  • The information necessary to direct the person and ensure appropriate care

We also collect the contact details of users’ relatives, where applicable.

2. FOR WHAT PURPOSES IS THIS PERSONAL DATA PROCESSED?

We process users’ personal data for the following purposes:

  • To provide individual follow‑up of users’ profiles and needs,
  • To direct users to the appropriate solution,
  • To analyse where users come from,
  • To monitor the commercial relationship,
  • To carry out satisfaction surveys in order to improve our services,
  • To send offers and marketing messages to users who have opted for this when registering.

3. WHAT ARE THE LEGAL BASES ALLOWING CASABARBARA TO PROCESS THIS PERSONAL DATA?

We process this personal data on the basis of:

  • Our legitimate interest in offering the most suitable services to users,
  • And, where applicable, the prior consent of individuals for the sending of offers and marketing messages by electronic means.

4. ON WHAT MEDIA AND FOR HOW LONG IS THIS PERSONAL DATA STORED?

Personal data is stored in paper and electronic form for the statutory retention periods or for as long as necessary for the purposes for which it was collected, namely two (2) years from the last contact with the person (Single Authorisation AU‑47 of the CNIL).​

5. WITH WHOM IS THIS PERSONAL DATA SHARED?

Internal use

We restrict access to personal data to Casa Barbara staff.​

We raise awareness among and train our staff on data protection issues and we undertake to take appropriate disciplinary measures in the event of non‑compliance with our internal procedures in this area.​

Processors

We host personal data with data hosting providers that comply with the applicable legislation and we also share this data with processors acting on our behalf.​ However, if processors have access to personal data, they must comply with the applicable legislation on the protection of personal data and with this information notice.​

Legal obligations

This personal data is not disclosed to third parties without the prior authorisation of the data subject, except in exceptional cases where the law or government authorities, such as the Commission Nationale Informatique et Libertés (CNIL) or the competent judicial authorities, require it.​

6. WHAT ARE THE RIGHTS OF INDIVIDUALS WHOSE DATA IS COLLECTED BY CASABARBARA AND HOW CAN THEY BE EXERCISED?

The European General Data Protection Regulation (GDPR) and the amended French Data Protection Act grant individuals' certain rights over their data.

For any processing of personal data concerning them, every person may exercise the following rights:

  • Right of access : everyone has the right to obtain a copy of the personal data that Casa Barbara holds and processes about them
  • Right to rectification : everyone has the right to rectify the personal data that Casa Barbara holds about them if it is inaccurate
  • Right to lodge a complaint with the CNIL : everyone has the right to lodge a complaint with the CNIL if they have concerns about how Casa Barbara processes their personal data

Every person may also exercise the following rights under certain conditions:

  • Right to erasure : everyone may ask Casa Barbara to erase their data
  • Right to restriction : everyone may ask Casa Barbara to restrict the processing of their data
  • Right to object : everyone may ask Casa Barbara to stop processing their data when the processing is based on Casa Barbara’s legitimate interest
  • Right to withdraw consent : everyone has the right to withdraw their consent if they have previously given consent to receive offers and marketing communications by electronic means
  • Right to object to the processing of data for marketing purposes : everyone may ask Casa Barbara at any time to stop sending them marketing communications

We undertake to respond within one month.​ If, for any reason, we are unable to comply with a request, we will explain to the data subject why their request has been refused.​

PURPOSE OF THE COOKIE POLICY

Casa Barbara, in its capacity as Data Controller, complies with the regulations applicable to cookies and other trackers.

For the purposes mentioned above, your personal data will be used within the Casa Barbara Group and may be transmitted to Casa Barbara subsidiaries in the countries where Casa Barbara operates.

To third parties

Your personal data may be transmitted to third parties, but only in the following cases:

  • For marketing purposes, if you have given your consent for this purpose
  • For support purposes: Casa Barbara uses service providers or contractors to provide support and maintenance for its online media and to administer these online media or the various features and programmes they contain; these third parties undertake to ensure that your personal data benefits from the same level of security as that offered by Casa Barbara
  • For litigation and security purposes: Casa Barbara may be required to disclose your personal data if required by law or if such disclosure is reasonably necessary to comply with legal proceedings, respond to claims or protect the security or rights of Casa Barbara, its customers or the public
  • In the event of a merger or acquisition of all or part of one of the Group’s subsidiaries by another company, or in the event of a sale or transfer, the purchaser would have access to information that may include personal data, subject to the applicable law; likewise, some of your personal data may be transferred in the context of a restructuring, insolvency proceedings or another similar event, where permitted by and in accordance with applicable law

TRANSFER OF PERSONAL DATA RELATED TO COOKIES OUTSIDE THE EUROPEAN UNION

Casa Barbara’s main service providers operating on its online media are based in the European Union, but they may work with companies located outside the European Union. Transfers of personal data to these service providers are carried out in accordance with the applicable laws and are based on standard contractual clauses as adopted by the European Commission. These service providers are also bound by a contract that guarantees a high level of confidentiality protection and requires them, among other things, to act only on Casa Barbara’s instructions and to implement all necessary technical measures on an ongoing basis to maintain the security of your personal data.

SECURING YOUR PERSONAL DATA

Casa Barbara will take all necessary technical and organisational measures to protect the confidentiality and security of your personal data collected via its online media.​ These measures include, in particular, (i) storing your personal data in secure operating environments that are not accessible to the public and are only accessible to authorised Casa Barbara staff and its contractors, and (ii) verifying the identity of registered users before they can access your personal data and monitoring the related access.​

  • You may request access to your personal data
  • You may request the rectification of your personal data if it is inaccurate, incomplete or out of date

  • You may request the erasure of your personal data where: (i) the personal data is no longer necessary for the purpose of the data processing, or (ii) you have withdrawn your consent to the data processing where consent is the sole basis for the processing

  • You also have the right to give general and specific instructions about the fate of your personal data after your death
